These Terms of Use ("Terms") govern access to and use of kampio.com and related services (the "Platform") operated by Kampio ("Kampio", "we", "us").

By browsing the Platform, creating an account, or completing a booking, you agree to be bound by these Terms. If you do not agree, you must stop using the Platform.

These terms govern use of Kampio and online bookings made through the platform. They do not replace personalized legal advice.

1. Acceptance and changes

Use of the Platform constitutes acceptance of the Terms in effect at the time of use.

Kampio may amend these Terms at any time. The "Last updated" date at the top indicates the applicable version. Changes take effect upon publication unless stated otherwise. Continued use after publication constitutes acceptance of the revised Terms.

2. Definitions

"Camper" or "User": any person who browses the Platform, creates an account, or completes a booking.

"Owner": any person or entity that publishes or manages a campground listing on the Platform.

"Campground": outdoor accommodation business listed on the Platform.

"Booking": a stay request or confirmation made through the Platform, including online payment when available.

"Commission": remuneration charged by Kampio on confirmed booking amounts, as set out in Section 9.

3. Kampio's role

Kampio operates a digital matching and booking platform. Unless expressly stated otherwise, Kampio does not operate campgrounds, provide accommodation, or act as a travel agent or employer of Owners.

Kampio facilitates campground discovery, booking requests, online payment processing when enabled, and related administration. The stay contract is between the Camper and the relevant Campground under the conditions shown at booking time.

4. User account

Some features (favorites, booking, owner area) require an account. You must provide accurate, complete, and up-to-date information.

You are responsible for safeguarding your credentials and for activity under your account. Notify Kampio promptly of unauthorized access.

Kampio may suspend or close an account for breach of these Terms, suspected fraud, or conduct harmful to the Platform or other users.

5. Permitted use and prohibited conduct

You agree to use the Platform lawfully, fairly, and respectfully.

You must not, among other things: publish unlawful, misleading, defamatory, or infringing content; attempt unauthorized access to the Platform, accounts, or data; use unauthorized bots, scrapers, or automation; bypass security or payment controls; book in bad faith or for unauthorized resale; harass other users or Owners.

Kampio may remove content, refuse a booking, or restrict access in case of breach.

6. Listings, rates, and availability

Descriptions, photos, maps, rates, availability, campground rules, and cancellation policies displayed on a listing come mainly from the Owner or Campground concerned.

Kampio strives to keep information reliable but does not guarantee the accuracy, completeness, or actual availability of every item. Final rates, applicable taxes, additional fees, and stay conditions are confirmed at booking or payment time.

7. Online bookings

When online booking is offered, you must carefully review the selected campground, dates, party size, site or unit type, total price, and applicable conditions before confirming.

A confirmed and paid booking (where applicable) creates a commitment between you and the Campground, subject to displayed conditions and actual availability. Kampio transmits necessary information to the Campground and keeps a transaction record.

Kampio may refuse, cancel, or limit a booking in case of obvious pricing error, suspected fraud, breach of these Terms, or technical impossibility.

8. Payments

Online payments are processed by a secure third-party payment provider (e.g. Stripe). Kampio does not store full card numbers.

Amounts are generally shown in Canadian dollars (CAD) unless otherwise indicated. Taxes, service fees, pet fees, extra guest fees, or options may apply according to the listing and final checkout.

You authorize charging the total amount shown at confirmation. If payment fails, the booking may be cancelled automatically.

9. Platform commissions and fees

Kampio may list a campground on the Platform at no upfront listing fee, depending on current terms. In exchange for matching, visibility, booking tools, and payment processing, Kampio charges a commission on each confirmed and paid booking made through the Platform.

Unless otherwise stated at booking time or in the owner area, the commission rate applicable to campground bookings is 10% of the gross amount paid by the Camper (taxes included or excluded as shown at payment time).

Commission is owed to Kampio once a paid booking is confirmed. It may be withheld from the amount remitted to the Owner or invoiced according to the payment model in place. Kampio may adjust its rates with reasonable notice published on the Platform or communicated to Owners; bookings already confirmed remain governed by the rate shown at confirmation time.

If a full or partial refund is granted to the Camper, Kampio's commission remains due and is never refunded, as it compensates Platform services already provided (matching, payment processing, booking management). Any refund, if applicable, relates to the stay portion owed to the Campground under the applicable policy.

Owners acknowledge that commission compensates access to the Platform and not a guaranteed booking volume.

10. Cancellations, changes, and refunds

Cancellation, change, and refund policies for a stay are determined by the Campground and/or displayed on the listing or at booking time.

Except where mandatory law requires otherwise, Kampio is not required to refund a stay denied, cancelled, or unused by the Camper when the Campground policy does not provide for it. Refund requests must be handled under the applicable policy and, where available, through Platform tools.

When a refund is granted, Kampio's commission is never refunded to the Camper nor returned by Kampio, even if the stay amount is refunded in full or in part. Except where mandatory law requires otherwise or due to an error attributable solely to Kampio, any refund applies only to the stay portion owed to the Campground.

In a dispute between a Camper and an Owner, Kampio may, without being obligated to do so, help facilitate communication. Kampio is not responsible for cancellation decisions made by a Campground.

11. Owner obligations

The Owner warrants that it has the rights and permits needed to publish its listing and receive bookings. It is solely responsible for published content, legal compliance of its business, camper safety, accuracy of rates and availability, and hosting/delivery of the stay.

The Owner agrees to honor bookings confirmed through the Platform, except in cases of force majeure or legitimate impossibility duly communicated. It must maintain a clear cancellation policy and honor it.

Kampio may remove, suspend, or modify a listing for substantiated complaints, non-compliance, fraud, insolvency, or repeated breach of these Terms.

12. Camper obligations

The Camper must provide accurate booking information, comply with campground rules, bylaws, applicable laws, and on-site safety instructions.

The Camper is responsible for damage caused by themselves, guests, pets, or equipment, to the extent permitted by law. They must verify that the selected campground meets their needs (RV access, pets, services, etc.).

13. Promotions and promo codes

Promotions or promo codes shown on the Platform are subject to their specific conditions (dates, eligible campground, minimum stay, non-stacking, etc.). Kampio and/or the Owner may withdraw or correct them in case of obvious error.

A promotion is valid only if accepted at payment time. Kampio is not liable for a code refused by a Campground when displayed conditions are not met.

14. Intellectual property

The Platform, its structure, design, trademarks, logos, text, databases, and software belong to Kampio or its licensors. Unauthorized copying, extraction, or exploitation is prohibited.

By publishing content on the Platform, the Owner grants Kampio a non-exclusive, worldwide, royalty-free license to host, display, technically adapt, and promote that content to operate the Platform.

15. Personal data

Processing of personal information related to the Platform is described in Kampio's Privacy Policy. By using the Platform, you acknowledge that you have read it.

Kampio may retain certain transactional, booking, and commission data in accordance with legal, accounting, and anti-fraud obligations.

16. Limitation of liability

To the extent permitted by applicable law, Kampio is not liable for the on-site stay, quality of facilities, acts or omissions of a Campground or Owner, or for indirect damages, lost profits, loss of enjoyment, delays, or unavailability.

The Platform is provided "as is" and "as available". Kampio does not guarantee uninterrupted or error-free operation.

Where prohibited by law, nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Kampio harmless from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising from: (a) your use of the Platform; (b) a booking made by you; (c) content you publish; (d) your breach of these Terms or applicable law.

18. Force majeure

Kampio is not liable for delay or failure due to events beyond its reasonable control, including network outage, cyber incident, natural disaster, war, strike, government action, or failure of an essential third-party provider.

19. Suspension and termination

Kampio may suspend or terminate access to the Platform, in whole or in part, for breach of these Terms, security risk, fraud, or legal obligation.

Provisions that by nature should survive termination (amounts due, commissions, intellectual property, limitation of liability, indemnification, governing law) will continue to apply.

20. Governing law and disputes

These Terms are governed by the laws applicable in Quebec and Canada, subject to mandatory consumer protection rules that may apply to your situation.

Except where mandatory law provides otherwise, any dispute relating to these Terms or use of the Platform shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Montreal, Quebec.

21. General provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

Kampio's failure to enforce any right under these Terms does not constitute a waiver.

These Terms, the Privacy Policy, and conditions displayed at booking time constitute the entire agreement between you and Kampio regarding use of the Platform, subject to stay-specific conditions with a Campground.
